Judge Tanya Chutkan, the Obama appointee who is supervising Jack Smith’s January 6 case versus Trump in DC officially delayed the trial on Friday.

On Thursday it was reported Jack Smith’s DC case versus Trump had actually been eliminated from the court calendar. The March 4, 2024 trial date, which was set up before Super Tuesday, was dropped from the calendar within the recently.

Judge Chutkan in an order Friday delayed the trial and informed the potential jurors who were asked to complete a pre-trial survey not to appear in court next week.

Chutkan was required to hold off the March 4 trial as the DC Circuit Court of Appeals thinks about Trump’s resistance claims.

Trump’s legal representatives argued that Trump is immune from federal prosecution for supposed ‘criminal offenses’ devoted while he worked as United States President.

” In 234 years of American history, no president ever dealt with prosecution for his main acts. Till 19 days back, no court had actually ever resolved whether resistance from such prosecution exists,” Trump’s legal representatives composed in last month’s filing, according to CBS News “To this day, no appellate court has actually resolved it. The concern stands amongst the most complicated, elaborate, and special problems that this Court will be contacted to choose.”

Last month, John Sauer, a Missouri-based lawyer for Trump, appeared before a three-judge panel for the DC Circuit Court of Appeals to argue Trump’s resistance claims in Jack Smith’s DC case.

The three-judge panel hearing oral arguments on resistance claims: Florence Pan (Biden appointee), Michelle Childs (Biden appointee), and Karen Henderson (George W. Bush appointee).

On January 9 a three-judge panel heard oral arguments and appeared hesitant of Trump’s resistance claims– one judge, a Biden appointee, asked lawyer John Sauer if Trump would undergo prosecution if he bought SEAL Team 6 to assassinate his political competitors.

” Could a president who bought SEAL Team 6 to assassinate a political competitor, and is not impeached, would he undergo prosecution?” Judge Florence Pan, a Biden appointee asked John Sauer.

John Sauer, previous Solicitor General of Missouri and pal of The Gateway Pundit, responded, “If he were impeached and founded guilty initially … my response is certified yes, there is a political procedure that would need to happen under the structure of our Constitution which would need impeachment and conviction by the Senate in these remarkable cases …”

If the DC Circuit Court of Appeals guidelines that Trump does not have governmental resistance, Trump will likely request an en banc hearing (an ask for the court’s whole slate of 11 judges to decide).

Out of the 11 judges at the DC Circuit Court of Appeals, just 4 are conservatives so Trump will likely need to take the resistance battle to the United States Supreme Court.

Meanwhile in Florida …

Judge Cannon, the Trump appointee who is managing Jack Smith’s categorized files case in Florida will hold a March 1 hearing to get a status upgrade on the unique counsel’s DC case.

Cannon recommended the May 20 trial date for the categorized files case will be delayed if the unique counsel could not solve the Trump resistance argument in a prompt way.
